The Board of Adjustment hears and decides appeals when it is alleged that there is an error in any order, requirement, decision, or determination made by the Director or administrative official in the administration and enforcement of the City’s Land Development Code. The Board also authorizes variances from the provisions of sections specifically enumerated in Article VI of the Land Development Code, where the Board expressly finds that the applicant has demonstrated that a literal enforcement of the provisions will, in an individual case, result in undue and unnecessary hardship(s) and that the request ensures the public health, safety and general welfare are protected.
The Board of Adjustment is a five-member board. The term of office is two years and no member is allowed to serve more than three consecutive terms.
